This document ("Terms and Conditions", "T&C" or simply "Terms") contains the terms and conditions for using the website https://nouavillas.com (the "Site") by any visitor or user thereof ("User" or "You"). By accessing and using the Site, the User confirms that they have read, understood, and accepted this document regarding the Terms and Conditions of Use of the Site. If you do not agree with the content of this document, please do not use the Site and its features. This document applies regardless of whether the Site is accessed from a desktop, mobile phone, tablet, or any other device, and regardless of the operating system or browser used to access the Site.

To the extent that the Site is technically managed by third parties or includes pages co-managed with marketing or sales partners, these relationships do not change the rule that the User primarily relates to the operator indicated in this section, unless expressly stated otherwise.
In the interpretation of this document, the following terms have the meaning below:
The Site has an exclusive role of informing and promoting the Project, as well as facilitating contact with the developer in order to obtain additional information, request offers, schedule a viewing, or initiate discussions regarding a possible purchase of a developed housing unit. Through the Site, information regarding the location, Project concept, types of housing developed, layouts, surfaces, renderings, photos, media galleries, specifications of the developed housing, facilities, estimated timelines for the development and delivery of housing, construction progress, price ranges, promotional offers, and viewing scheduling options may be presented, by way of example and without limitation.
The content of the Site is purely informational and does not represent a firm offer, irrevocable offer, unilateral promise to contract, bilateral promise of sale, firm reservation, or other binding legal commitment on Our part. For the avoidance of any doubt, the mere publication of information on the site, the submission of a form, or the holding of preliminary discussions do not generate obligations for Cessena to conclude a contract, nor do they give the User the right to claim the allocation of a specific housing unit.
All materials presented on the Site, including but not limited to renderings, images, sketches, plans, partitions, surfaces, technical descriptions, equipment, finishes, information on unit availability, prices, estimated execution/completion/delivery dates, or any other commercial presentations, are exclusively indicative and may undergo changes depending on the project's evolution, technical, urbanistic, commercial, operational, or legal considerations. The final characteristics of the properties developed within the Project, as well as the legal and commercial conditions applicable to them, will result exclusively from the contractual, technical, and legal documentation agreed between the parties at the time of concluding the transaction for the purchase of a housing unit.
Unless expressly stated otherwise:
The Site may include presentations of the residential project, images, renderings, sketches, visual simulations, partitioning plans, surfaces, technical specifications, information on equipment, finishes, infrastructure, facilities, surroundings, prices, and unit availability. The User understands and accepts that such elements have an illustrative, indicative, and informational character and may not exhaustively or definitively reflect the final form of the Project or individual units.
Renderings, images, and visual materials may contain artistic presentation elements, simulations, furniture, landscaping, vegetation, finishes, equipment, or other accessories that will not necessarily be included in the final form of the property and have no contractual value unless expressly provided for in the signed contractual documents. Surfaces, partitions, locations, equipment, finishes, prices, availability, and any other characteristics of the properties can be modified at any time, depending on the project status, technical requirements, applicable authorizations, commercial needs, or other objective circumstances.
The information published on the Site does not replace the individual verification of the legal and technical documentation for each property and cannot, by itself, substantiate an acquisition decision without analyzing the applicable contractual documents and conditions.
By transmitting any message, request for information, request for offer, request to schedule a viewing, or other materials through the Site or through the contact details published on it, the User declares that they have the right to transmit that information and that it does not violate the law or the rights of third parties. It is strictly forbidden to transmit via the Site any illegal, false, misleading, defamatory, offensive, discriminatory, threatening, obscene, abusive content, as well as any content containing viruses, malware, malicious code, or spam elements.
Cessena reserves the right to ignore, archive, or reject communications that contravene the law, these provisions, or its legitimate interests. Submitting a Request through the Site does not oblige Cessena to accept it, to formulate an offer, to reserve a unit, or to initiate or finalize a transaction. Until the signing of a confidentiality agreement, a reservation, a promise of sale, a sales contract, or another express document, the mere transmission of information or documents by the User does not, by itself, create additional contractual obligations for Cessena.
In certain situations, Cessena may send Users, by e-mail, messaging, hyperlink, digital platforms, or other means of communication, additional materials regarding the residential project, including, without limitation, virtual tours, digital brochures, detailed plans, unit sheets, price lists, commercial presentations, visual simulations, or other informational documents. Unless expressly provided otherwise within the respective materials or in a separate contractual document, all these materials have exclusively an informational, indicative, and promotional character, are part of the Project's presentation materials, and have no contractual value.
Access to such materials may be limited, conditioned, temporarily restricted, or granted only at a certain stage of commercial discussions, at the option of the Site Operator. The Site Operator reserves the right to modify, update, withdraw, replace, or cease the transmission of these materials at any time, without the obligation of prior notice.
The User understands that the information contained in such materials does not replace the legal, technical, or contractual documentation related to the property and cannot, by itself, substantiate the existence of an obligation to sell, reserve, or maintain a specific commercial offer. All materials transmitted upon request, including, without limitation, digital brochures, plans, unit sheets, virtual tours, price lists, commercial presentations, and any other similar documents or materials, remain the property of the Site Operator and/or the owners who authorized their use in connection with the project (e.g., architects).
It is forbidden to copy, reproduce, distribute, reuse, or commercially exploit, in whole or in part, the materials transmitted upon request, in any form and by any means. Materials transmitted upon request may be used exclusively for the purpose of analyzing the Project and evaluating a possible intention to purchase or request additional information, without their transmission being interpreted as a license, assignment, permission to reuse, or transfer of any intellectual property right over them.
The content of the Site, including, but not limited to, the design, texts, descriptions, Site structure, images, photos, renderings, plans, sketches, graphical elements, logos, names, databases, selection, and organization of information, as well as any other published materials, are protected by legislation on copyright, related rights, and/or other applicable intellectual property rights. No provision within these Terms transfers to the User any intellectual property right over the Site's content.
The User is granted exclusively a limited, revocable, non-exclusive, and non-transferable right to access and consult the Site for personal and informational purposes, within the limits of its normal use. The use, reproduction, adaptation, extraction, republication, distribution, or commercial exploitation, in whole or in part, of any content element of the Site without the express, prior, and written consent of the rights holder is strictly prohibited.
Using the Project's name, branding elements, photographs, or promotional materials in ads, campaigns, comparative materials, or public communications of third parties is permitted only with the express consent of the Site Operator or the rights holder. To the extent that certain images, plans, renderings, names, trademarks, or other materials belong to third parties, the rights over them remain in the patrimony of the respective holders.
The processing of personal data carried out in the context of using the Site, including in connection with contact forms, offer requests, viewing requests, or commercial communications, is done in accordance with the Privacy Policy available on the Site. The use of cookies and similar technologies is carried out in accordance with the Cookie Policy and with the options expressed by the User through the preference management mechanisms available on the Site, where applicable.
The Site Operator may modify, update, suspend, or temporarily or permanently interrupt the Site or certain sections, functionalities, or information available on it, for maintenance, updates, as well as for technical, commercial, operational, or security reasons, without the need for prior notification to Users. The Site Operator may implement technical and organizational measures to protect the Site, technical infrastructure, and data, including filters, access limitations, monitoring, anti-abuse systems, and other reasonable security solutions. The Site Operator does not guarantee, for any reason, that the Site will be available uninterrupted, free of errors, compatible with all devices, or completely secure against all cyber risks.
The Site may contain links to sites, applications, or services belonging to third parties, including, but not limited to, social networks, video platforms, external forms, or other tools integrated into the Site. The Site Operator does not control and is not responsible for the content, policies, practices, security, or availability of these third parties, nor for any damages or inconveniences resulting from accessing or using them. Accessing resources belonging to third parties is done exclusively at the User's own risk and in accordance with the terms and policies applicable to those respective third parties.
To the extent permitted by law, the Site Operator is not liable for any direct, indirect, incidental, special, or consequential damages resulting in or in connection with the access, use, inability to use, or reliance on the information, materials, or functionalities available on the Site, including, but not limited to, loss of opportunity, commercial losses, incurred costs, investment decisions, or misunderstandings generated by the interpretation of the content or the Project's presentation materials.
Without prejudice to the general nature of the above provisions, this limitation applies including in connection with:
The User understands and accepts that the information available on the Site and the materials transmitted upon request have exclusively an informational and indicative character, and that any decision regarding expressing interest in a unit, formulating a purchase intention, reserving, or concluding a transaction must be based on the verification of the applicable legal, technical, and commercial documentation, and not exclusively on the content of the Site. No provision in this section excludes or limits the liability of the Site Operator in cases where such exclusion or limitation is prohibited by applicable mandatory legal rules.
The Operator is not liable for the non-performance or improper performance of the obligations arising from the operation of the Site if this is caused by an event beyond its reasonable control, including, but not limited to, network failures, power outages, cyber-attacks, unavailability of hosting providers, measures of authorities, natural phenomena, or other force majeure events, as this institution is recognized and defined by law.
These Terms are governed by Romanian law. Any misunderstanding resulting from or in connection with the use of the Site will be resolved primarily amicably. To the extent that amicable resolution is not possible, jurisdiction rests with the competent courts according to the law. Unless the law prohibits it, territorial jurisdiction may fall to the competent courts at the Operator's headquarters.
The Site Operator reserves the right to modify these provisions at any time, in particular to reflect legislative changes, changes regarding the Site's structure, functionality, or content, as well as changes regarding the promoted Project. The applicable version is the one published on the Site on the date of its use. The date of the "Last updated" mention indicates the moment of the last revision.
If any provision of these Terms is declared null, illegal, or inapplicable, the other provisions remain valid and continue to produce effects, to the extent permitted by law. These Terms, together with the Privacy Policy and the Cookie Policy, represent the general framework applicable to the use of the Site. The Site Operator may transfer or assign the rights and obligations arising from these provisions in the context of a reorganization, corporate restructuring, transfer of the project, transfer of activity, or outsourcing of certain operational functions, in compliance with applicable legislation.
